2. Orders, Prices and Payment
All orders are subject to acceptance by KITABEE ACADEMY. We may refuse, cancel, review, or delay an order where payment fails, stock is unavailable, pricing is incorrect, information is incomplete, fraud is suspected, access is misused, or a product is no longer available.
- Prices are listed in Australian dollars unless clearly stated otherwise.
- Prices, promotions, bundles, availability, course access periods, book quantities, and product details may change from time to time.
- Payment must be successfully completed before physical books are dispatched or digital/course access is activated, unless we agree otherwise in writing.

- You are responsible for ensuring that your billing, delivery, and contact details are accurate before submitting your order.
3. Online Course Access
Online course access is provided through the KITABEE ACADEMY website or approved platforms. Access may depend on your account status, payment status, product type, enrolment period, internet connection, device, browser, and platform availability.
- Your course account is personal to the registered user and must not be shared, sold, transferred, copied, or used by unauthorised people.
- We may suspend or cancel access if your account is misused, shared, used for copying, used for scraping, used for unauthorised teaching, or used in breach of these Terms & Conditions.
- Course materials may be updated, improved, replaced, removed, reorganised, or corrected from time to time.
- We do not guarantee that every course, lesson, activity, video, quiz, game, or digital resource will remain available permanently.
- You are responsible for maintaining your login details, device access, internet connection, software updates, and account security.
4. Physical Books and Delivery
Physical books are supplied according to the product description and stock availability at the time of purchase. Images on the website are for identification and presentation purposes and may not perfectly reflect colour, lighting, screen display, or minor printing variations.
- Delivery times are estimates only unless a specific guarantee is expressly provided in writing.
- KITABEE ACADEMY is not responsible for delays caused by courier services, postal services, incorrect addresses, failed delivery attempts, customs processes, weather events, public holidays, or events outside our reasonable control.
- You must provide a correct and complete delivery address. Additional postage or replacement costs may apply if a parcel is returned, lost, or delayed because of incorrect information supplied by you.
- Risk in physical goods may pass to you on delivery, subject to rights that cannot be excluded under Australian law.
- If you receive the wrong item, a damaged item, or an incomplete order, contact us within a reasonable time and provide order details and clear photos where requested.

Unless we give written permission, all rights are reserved. Purchasing a book, course, digital product, trial, bundle, or membership gives you a limited right to use the material for the approved learning purpose only. It does not transfer ownership or copyright.
- You must not copy, scan, photograph, translate, adapt, reproduce, publish, distribute, upload, sell, rent, licence, or share KITABEE ACADEMY content without written permission.

7. Students, Parents, Teachers and Organisations
KITABEE ACADEMY materials may be used by individual students, parents supporting their children, approved teachers, schools, tutors, language centres, and organisations according to the licence, product, or permission granted at purchase.
- Individual purchases are for personal or family learning use only unless a commercial, school, centre, or group licence is approved.
- Private teachers, schools, tutors, organisations, and language centres must not use individual student materials for commercial classes, mass printing, group teaching, or institutional delivery unless the correct licence or written permission has been obtained.
- Parents and guardians are responsible for supervising minors when using online courses, games, videos, downloads, and internet-based learning tools.
- Teachers and institutions are responsible for ensuring that student use is lawful, safe, supervised, age-appropriate, and consistent with these Terms & Conditions.
8. Learning Outcomes
KITABEE ACADEMY provides educational resources designed to support Arabic learning. Learning outcomes vary depending on age, attendance, consistency, practice, prior knowledge, parent support, teacher support, student effort, learning needs, and personal circumstances.
We do not guarantee fluency, exam results, school grades, religious outcomes, business outcomes, migration outcomes, employment outcomes, or any fixed learning result. Our books, courses, games, and materials are educational support tools and must be used consistently for best results.
9. Refunds, Returns and Cancellations
Refunds, returns, replacements, cancellations, and remedies are handled according to our published policies and applicable law. Digital products and online course access may have different refund conditions from physical books due to immediate access, downloads, or use of digital content.
- A change of mind may not automatically entitle you to a refund unless our policy or applicable law provides otherwise.
- Once digital content has been accessed, downloaded, viewed, or used, refund options may be limited except where required by law.
- Physical books returned for change of mind may need to be unused, clean, complete, undamaged, and returned within the required period if our policy allows that return.
- Where a product or service fails to meet a consumer guarantee, you may have rights to a repair, replacement, refund, cancellation, or other remedy under Australian Consumer Law.
10. Australian Consumer Law
Nothing in these Terms & Conditions excludes, restricts, or modifies any consumer guarantees, rights, remedies, or protections that cannot legally be excluded under Australian Consumer Law or other applicable laws.
Customers may have rights where goods or services do not meet consumer guarantees, including acceptable quality, matching description, fitness for disclosed purpose, delivery within a reasonable time where applicable, and services performed with reasonable care and skill where applicable.
If there is any inconsistency between these Terms & Conditions and a right that cannot be excluded by law, the non-excludable legal right will prevail.
11. Account Security and Misuse
You are responsible for keeping your login details private and secure. You must notify us if you believe your account has been accessed without permission.
- You must not attempt to bypass access restrictions, payment systems, download limits, licence limits, security measures, or platform protections.
- You must not use bots, scrapers, automated tools, fake accounts, shared accounts, or unauthorised extensions to access or copy content.
- We may suspend, restrict, or cancel accounts that appear to be used for abuse, copying, fraud, unauthorised sharing, harassment, security attacks, or breach of these terms.
12. Privacy and Communications
KITABEE ACADEMY may collect and use personal information to process orders, provide course access, deliver physical books, manage student accounts, support learning, communicate with customers, improve services, prevent misuse, and comply with legal obligations.
- Parents, schools, teachers, and organisations must only provide student information if they have authority or consent to do so.
- Commercial emails, SMS, newsletters, promotions, and marketing messages should comply with applicable consent, sender identification, and unsubscribe requirements.

Some KITABEE ACADEMY products may use third-party platforms, payment gateways, video hosting, learning tools, games, plugins, email systems, analytics tools, or external links. These services may have their own terms, privacy policies, technical requirements, and availability limits.
We are not responsible for third-party outages, platform changes, external content, internet failure, device issues, browser restrictions, payment gateway delays, or limitations caused by external services, except where liability cannot legally be excluded.
14. No Liability and Limitation of Responsibility
To the maximum extent permitted by law, KITABEE ACADEMY is not liable for indirect, incidental, special, consequential, financial, educational, business, data, reputation, or opportunity loss arising from the purchase, access, use, misuse, inability to use, or reliance on our books, courses, digital products, websites, games, accounts, live sessions, or learning materials.

- Nothing in these Terms & Conditions limits or excludes liability that cannot legally be limited or excluded under Australian law.
15. Suspension, Refusal and Termination
KITABEE ACADEMY may suspend access, cancel an account, refuse service, cancel an order, block downloads, remove access, or take legal action if a customer or user breaches these Terms & Conditions, infringes copyright, shares access, misuses materials, abuses staff or students, acts dishonestly, attempts fraud, or harms our business, platform, students, teachers, or reputation.
Where legally permitted, no refund will be provided if access is suspended or terminated because of serious misuse, copyright infringement, account sharing, fraud, abuse, or breach of these Terms & Conditions.
16. Governing Law and Updates
These Terms & Conditions are governed by the laws of Australia and, where applicable, the laws of the Australian State or Territory in which KITABEE ACADEMY operates or is legally registered.
